Ky. Court: Tell students of rights before questioning

LOUISVILLE, KY (AP/FOX19)- School administrators and school resource officers cannot question students without first reading the student their Miranda rights. The Kentucky Supreme Court made that decision Thursday.

The ruling stems from a case in Nelson County where a student confessed to bringing hydrocodone to school and sharing it with a classmate. The court concluded the student was not informed of possible criminal implications while speaking with the assistant principal and resource officer until after admitting to the offense, therefore his admissions were inadmissible in court.

"Legally the moral of this story is, if you're going to bring a juvenile in for questioning don't have a school resource officer there if you don't want it to turn into a criminal charge," said Mike Allen, FOX19's legal analyst.

The principal at Campbell County High School, Renee Boots, says she has some concerns about the ruling.
